1. Organising Company

CAFÉS BATALLA 2000 S.L., Spanish entity, holder of Spanish tax identification number. B 31543259, with address at calle C, Parcela 69, N-1. 3. Mechanism for designating the winner

The winner will be drawn from all the participants who have commented and tagged in the publication, fulfilling all the requirements set out in these Rules, at the discretion of BATALLA CAFÉS.

The drawing of lots will be carried out using a random selection software, by means of

APPSORTEOS, which will choose 1 winner and 2 alternates in correlative order.

The prize will be awarded to the participant who is chosen in the draw from among all the participants and who is declared the winner, in accordance with the requirements set out in these Rules.

4. Verification of Eligibility and Declaration of Winners

Once the winner has been chosen, BATALLA CAFÉS will verify that the successful entrant fulfils all the requirements set out in these Rules and that he/she is eligible to be declared the winner.

To this end, BATALLA CAFÉS will contact the presumed winner via a direct message to the winner's Instagram profile, informing him/her that he/she is the winner. The entrant must respond to this message within a maximum period of 48 hours from the moment the comment has been made on the Instagram post with the following information: (i) express agreement and acceptance of the prize or (ii) express waiver of the prize (conditional or limited acceptances will not be valid), via a direct message to BATALLA CAFÉS.

If the presumed winner renounces the prize, BATALLA CAFÉS will proceed to communicate in the same terms as described above with the first alternate for the purpose of proposing him/her and if applicable (if he/she does not resign in turn) following the steps for the declaration of the winner as indicated above.

Likewise, in the event that any of those chosen as the presumed winner or alternate winner does not reply to the message within the aforementioned time limit, or BATALLA CAFÉS considers that he/she does not meet the requirements to be declared the winner, he/she will contact the next alternate for the purpose of proposing him/her and if applicable (if he/she does not resign) following the steps for the declaration of the winner as indicated above.

Once the maximum number of substitutes has been reached, several or all of them have resigned or do not meet the requirements set out in these Rules, BATALLA CAFÉS you can

(i) award the prize only to the resulting valid winner or (ii) declare the Competition void.

In the event that BATALLA CAFÉS The names of the winners may be published by BATALLA CAFÉS on its different digital platforms such as its blog (https://cafesbatalla.com/noticias/) or its Facebook and/or Instagram page, in accordance with the provisions of these Rules.

5. Awards

All participants will be raffled a Piston Coffee Maker and two packs of Costa Rica Café Mujer Solidario with MAMAPOP.

Under no circumstances may the Prize be subject to change, alteration or compensation at the winner's request.

6. Personal Data and Image Rights

The participant declares and declares publicly and solemnly to be the author of the image, or the legitimate holder of the moral and intellectual property rights of the images that he/she inserts in the application or submits to the Competition, and to have obtained the assignment of these rights or the unequivocal consent of the persons whose image he/she disseminates, including but not limited to the rights of reproduction, distribution, transformation, advertising and commercial exploitation, exhibition and public communication.

Likewise, as author, owner or legitimate assignee of the reproduction and exhibition rights of the photographs submitted to the Competition (hereinafter, the “Photographs”), the entrant hereby assigns to BATALLA CAFÉS, The rights to the Photographs, including, but not limited to, the following, including, but not limited to, the following intellectual property rights, exclusively, for the entire world and for the maximum time permitted by law:

• The right to distribute the Photographs by sale, rental, lending or otherwise for private or public use, including without limitation the right to create, make or produce and distribute any form of consumer products through the use of any printed or recorded material (including, without limitation, animated books and toys with music and/or lyrics, educational products and other promotional or marketing materials (“merchandising”), interactive and computer products and services (such as CD Rom, computer network products or equipment, computer games, etc.), by sale, rental, lending or otherwise for private or public use; and), whether for sale, hire, loan or otherwise for private or public use;

In relation to this Competition, it will be necessary for the success of the same that the Facebook and/or Instagram account data automatically collected from the participants and those provided by whoever is chosen in the draw are truthful, complete and current, to which they undertake to provide.

7. Other rules of use

Offensive comments, insults, threats, foul language, degrading content or disqualifications towards our products and services, brands, staff or other members of the community will not be accepted.

Likewise, we will remove or restrict advertising comments or comments about our competition, both explicit and covert, as we believe that this is not the right place to host this type of information.

BATALLA CAFÉS is exempt from any liability for damages of any kind that may be due to the temporary lack of availability or continuity of the functioning of the services by means of which the participants take part in the Competition, the defrauding of the usefulness that the participants may have attributed to them, and in particular, although not exclusively, to failures in accessing the different pages and sending participation responses via the Internet.

BATALLA CAFÉS reserves the right to make any changes it considers necessary for the success of the Competition, when there is just cause or reasons of force majeure that prevent it from being carried out in the manner set out in these Rules.

BATALLA CAFÉS reserves the right to postpone and/or extend the duration of the Competition, as well as the right to interpret these Rules.

Also, BATALLA CAFÉS is exempt from all liability in the event of any of the aforementioned cases, as well as from any liability for damages that may be caused during the enjoyment of the Prize.

8. Acceptance of the rules

The simple participation in the Competition implies the acceptance of these Rules, and therefore the manifestation in the sense of not accepting all or part of them will imply the exclusion of the participant and as a consequence of this, BATALLA CAFÉS shall be released from its obligation to that Participant.
